A K-3 visa is a nonimmigrant visa designed for spouses of U.S. citizens who are waiting for their immigrant visa (green card) to be processed. It allows the foreign spouse to enter and stay in the U.S. while the permanent residency application (Form I-130) is still pending.


Who Can Apply for a K-3 Visa?

To be eligible for a K-3 visa, you must:
✅ Be legally married to a U.S. citizen (not just engaged).
✅ Have a pending I-130 (Petition for Alien Relative) filed by your U.S. citizen spouse.
✅ Intend to live in the U.S. while waiting for your green card.
✅ Apply from outside the U.S. (K-3 visas are processed at U.S. consulates abroad).

K-3 Visa Application Process 📝

1️⃣ U.S. Citizen Files I-130

  • The U.S. citizen files Form I-130 (Petition for Alien Relative) with USCIS.

2️⃣ File Form I-129F (Petition for Alien Fiancé(e))

  • After receiving the I-130 receipt notice, the U.S. citizen files Form I-129F to request the K-3 visa.

3️⃣ Approval & Visa Interview

  • If USCIS approves the I-129F, the foreign spouse attends an interview at the nearest U.S. consulate.

4️⃣ Entry to the U.S. & Green Card Process

  • Once approved, the spouse enters the U.S. on a K-3 visa and waits for the I-130 approval to apply for a green card (Adjustment of Status – Form I-485).

How Long Does It Take?

  • K-3 Visa Processing Time: Usually 6–12 months, depending on USCIS and consulate workloads.
  • Green Card Processing (I-130 Approval): Can take 12–24 months.

Important Notes About the K-3 Visa 🚨

❌ The K-3 visa is rarely issued today because most I-130 petitions get approved before the K-3 visa is processed.
❌ If the I-130 is approved before the K-3 visa, the spouse must wait for the immigrant visa instead.
❌ A K-3 visa does not automatically grant permanent residency – the spouse must still apply for a green card.


Alternatives to the K-3 Visa

🔹 Direct Immigrant Visa (CR-1/IR-1 Visa) – If the I-130 is processed quickly, the foreign spouse can enter the U.S. as a permanent resident instead of applying for a K-3.
🔹 Fiancé(e) Visa (K-1 Visa) – If the couple is not yet married, a K-1 fiancé(e) visa might be a better option.
